Terms of Use

These Terms of Use ("Terms") govern your access to and use of Quackstack's website, applications, APIs, and other services ("Service"). By using the Service you agree to these Terms.

1. Account

You must be at least 16 years old. You're responsible for maintaining the security of your account credentials and for all activity under your account.

2. Acceptable use

You agree not to:

  • Use the Service to violate any law or third-party right;
  • Reverse engineer or extract the underlying model weights;
  • Resell or sublicense the Service without a written agreement;
  • Submit content you don't have the right to submit;
  • Use the Service to harass, defraud, or generate harmful content.

3. Quack quotas

Each plan includes a monthly quack allowance. Overages may be throttled or billed at the per-quack rate listed on our pricing page.

4. Customer content

You retain all rights to content you submit ("Customer Content"). You grant Quackstack a limited license to process Customer Content solely to provide the Service. We do not train shared models on Customer Content.

5. Fees and billing

Paid plans are billed monthly or annually in advance. Fees are non-refundable except where required by law. You authorize us to charge your payment method for all fees.

6. Termination

You may cancel at any time. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The duck has opinions; they are not professional advice.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws rules.

10. Changes

We may update these Terms. Material changes will be announced by email at least 30 days in advance.
